1.About these terms
These Terms of Service (“Terms”) are an agreement between you and GetSurePass (“GetSurePass”, “we”, “us”), which is operated by Technest Digital Solutionz (BN 9933822), about your use of the GetSurePass website, web app, mobile app and related services (together, the “Service”).
Technest Digital Solutionz is a business name registered with the Corporate Affairs Commission (CAC) under the Companies and Allied Matters Act 2020, registration number BN 9933822, and is owned and run by its sole proprietor, Kingsley Dike.
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
If you use GetSurePass on behalf of a school, tutorial centre or other organisation, you confirm that you are authorised to accept these Terms for it, and “you” includes that organisation.
2.What GetSurePass provides
GetSurePass helps students prepare for examinations, especially the Unified Tertiary Matriculation Examination (UTME) conducted by JAMB. The Service includes timed computer-based practice exams, past and practice questions, result reviews with explanations, an AI study tutor, a daily question, progress tracking, leaderboards, a prepaid wallet, premium subscriptions, sponsorship for parents and sponsors, and accounts for schools and tutorial centres.
We work to keep questions accurate and useful, but we do not guarantee any exam score, admission or other outcome. Your results in a real examination depend on many things outside our control.
3.Who can use GetSurePass
- You must give accurate information when you register and keep it up to date.
- If you are under 18, you may use GetSurePass only with the permission of your parent or legal guardian, who must also agree to these Terms and our Privacy Policy. By signing up, you confirm this permission. Parents and guardians are responsible for their child’s use of the Service and any payments they make.
- You may not use the Service if we have previously suspended or closed your account for breaking these Terms, unless we agree otherwise.
4.Your account and its security
- One person, one account. Your account is personal. Do not share your login or let anyone else use your account, and do not create accounts for other people without their permission (or, for a child, their parent’s permission).
- One device at a time. To protect accounts and prevent sharing, signing in on a new device signs out the previous one.
- You are responsible for keeping your password secret and for activity on your account. Use a strong password that you do not use anywhere else.
- If you think someone else has accessed your account, change your password immediately and tell us.
- If you sign in with Google or Facebook, you are also bound by that provider’s terms, and you are responsible for keeping that account secure.
6.Your wallet, payments and refunds
- What the wallet is: a prepaid balance for buying GetSurePass services such as premium and sponsorships. It is not a bank account or savings account, does not earn interest, and cannot be transferred to another account or withdrawn as cash, except as stated below.
- Funding: you fund your wallet through Paystack with any amount from ₦100 to ₦1,000,000 per payment. Paystack’s terms also apply to your payment. Your balance updates only after Paystack confirms the payment to us, which usually takes a few seconds; being redirected back to GetSurePass does not by itself mean a payment succeeded.
- Fees: we do not add a charge for funding your wallet. Your bank or card provider may charge its own fees.
Refunds
- Failed, duplicate or wrong charges: if you were charged but your wallet was not credited, or you were charged twice, contact us with your payment reference. We will investigate with Paystack and credit your wallet or refund the money to your original payment method.
- Unused wallet balance: you may request a refund of a wallet top-up that has not been spent within 14 days of the payment. We refund to the original payment method, less any non-refundable charges imposed by the payment provider.
- Premium already started is generally not refundable, except where the Service was not provided as described or where the law gives you a right to a refund.
- If we close your account without you having broken these Terms, we will refund your unused wallet balance.
- Nothing in these Terms limits your rights under the Federal Competition and Consumer Protection Act 2018 or other consumer protection law.
7.Sponsorship, referrals and institutions
Sponsoring a learner
Parents, guardians and other sponsors can link a learner’s account using the learner’s email and pay for 1 to 24 months of premium from their own wallet. A sponsorship is a gift of premium time to the learner and is final once confirmed, except for the refund cases in section 6. Only link accounts of learners who know and agree to it.
Referrals
Each account has a referral code. When someone signs up with your code and makes their first payment of at least ₦500, you receive a one-time reward of ₦100 in your wallet. Referral rewards are wallet credit only. Creating fake accounts, referring yourself, or any other abuse of referrals will lead to rewards being reversed and may lead to your account being closed. We may change or end the referral programme with notice; rewards already earned are kept.
Schools and tutorial centres
- Institution accounts can add learners who already have GetSurePass student accounts and view their usernames, emails, photos and average progress. A learner can belong to only one institution.
- Institutions must have the permission of each learner (and, for learners under 18, their parent or guardian) before adding them, and must use learners’ information only to support their education.
- Learners referred by an institution’s code earn that institution a commission of 12% of the learner’s wallet payments, credited to the institution’s wallet.
- Seat pricing and discounts for institution access requests are quoted by GetSurePass and confirmed in writing.
8.Exam rules
- Our servers keep the official time. The countdown on your screen is a guide. When time runs out, your exam is submitted automatically.
- If your connection drops, your answers are saved on your device and submitted when you reconnect. Answers that reach us more than 5 minutes after the exam’s end time are not counted, and that attempt scores zero. Please practise with a stable connection near the end of an exam.
- Scores, correct answers and explanations come from our servers. Correct answers are revealed only after you submit.
- Hints and the AI tutor are learning aids. Using them is allowed; trying to extract answers by tampering with the app is not.
- If you find an error in a question, please report it using the report option. We review every report.
9.The AI study tutor
The AI tutor gives explanations, hints, study suggestions and help using GetSurePass. It is an automated system and can make mistakes. Do not rely on it as your only source for important facts; check against your textbooks and the official syllabus. It is not a substitute for teachers, and it is not professional, medical, legal or financial advice.
Use the tutor for learning only. Do not use it to generate harmful, abusive, illegal or misleading content, and do not share personal information in your messages. The tutor has a fair-use limit on how many requests you can make each hour.
10.Acceptable use
You agree not to:
- share, sell, rent or lend your account, or let others use your premium access;
- copy, scrape, download in bulk, republish or sell our questions, explanations or other content, or build a competing question bank from them;
- use bots, scripts or automated tools to access the Service, take exams, or collect data;
- interfere with exam timing or scoring, tamper with the app or its network traffic, or try to discover answers before submitting;
- probe, scan or test the security of the Service, or try to access other people’s accounts or data, except through a responsible-disclosure report to us;
- overload, disrupt or reverse-engineer the Service, except where the law expressly allows it;
- upload profile photos or send messages that are offensive, sexual, hateful, harassing, defamatory, or that infringe someone else’s rights;
- impersonate anyone, or give false information when you register, link a learner or request institution access;
- abuse payments, refunds, referrals or promotions, or use stolen payment details;
- use the Service in any way that breaks Nigerian law or the law that applies to you.
If you discover a security weakness, please report it to us privately and give us reasonable time to fix it before telling anyone else.
11.Our content and yours
The Service, including its software, design, explanations, question selections and arrangements, branding and other content we create, belongs to GetSurePass or our licensors and is protected by the Copyright Act 2022 and other laws. Some questions are based on past public examinations; we do not claim ownership of the examination bodies’ original materials.
We give you a personal, non-exclusive, non-transferable licence to use the Service for your own exam preparation (or, for institutions, to support your learners) while your account is in good standing. You may not use our content commercially.
You keep ownership of what you submit, such as your profile photo, messages and question reports. You give us permission to store, display and use it as needed to provide and improve the Service — for example, showing your photo on the leaderboard or using your report to correct a question.
If you believe content on GetSurePass infringes your rights, contact us with the details and we will look into it promptly.
12.Availability and changes to the Service
We aim to keep GetSurePass available and reliable, but we cannot promise it will always be uninterrupted or error-free. We may need to pause it for maintenance, updates or reasons outside our control, such as network or power outages, provider failures or government action.
We regularly improve the Service and may add, change or remove features. If we remove a major paid feature, we will give you reasonable notice and, where appropriate, a proportionate refund or extension of your premium.
13.Suspension and closing your account
You can stop using GetSurePass at any time and ask us to delete your account by contacting us. See our Privacy Policy for what happens to your data and section 6 for refunds of unused wallet balance.
We may suspend or close your account, or remove content, if you seriously or repeatedly break these Terms, if we must do so by law, or to protect other users or the Service. Where reasonable, we will tell you why and give you a chance to respond first. If we close your account because you broke these Terms (for example, payment fraud or account selling), we may withhold rewards or credit obtained through that breach.
14.Disclaimers and limits on our liability
We provide the Service with reasonable care and skill. Apart from that, and to the extent the law allows, the Service is provided “as is”: we do not promise that every question or explanation is free from error, that the Service will meet every need, or that using it will produce any particular result.
To the extent the law allows, GetSurePass is not liable for:
- exam results, admission decisions or other outcomes;
- losses caused by your device, internet connection, or electricity supply, or by events outside our reasonable control;
- losses caused by someone using your account because you shared your login or did not keep it secure;
- indirect or consequential losses, such as lost opportunities, that were not reasonably foreseeable.
Our total liability to you for any claim relating to the Service is limited to the amount you paid to GetSurePass in the 12 months before the claim arose.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Nigerian law, including liability for death or personal injury caused by negligence, for fraud, or your rights as a consumer under the Federal Competition and Consumer Protection Act 2018.
15.Your responsibility to us
If you break these Terms or the law while using the Service, and that causes a claim against GetSurePass by someone else, you agree to cover our reasonable losses and costs from that claim. This does not apply to consumers to the extent the law does not allow it.
16.Governing law and disputes
These Terms are governed by the laws of the Federal Republic of Nigeria.
If you have a complaint, please contact us first; most issues can be solved quickly. If we cannot resolve a dispute within 30 days, either of us may refer it to mediation, and otherwise to the courts of Lagos State, Nigeria. As a consumer, you may also contact the Federal Competition and Consumer Protection Commission (FCCPC), and you keep any right to bring a claim in the courts where you live.
17.General
- Changes to these Terms: we may update these Terms when the Service or the law changes. We will notify you in the app or by email at least 14 days before significant changes take effect. If you keep using the Service after that, the new Terms apply; if you do not agree, you can close your account.
- Whole agreement: these Terms, our Privacy Policy and any written agreement with an institution are the whole agreement between us about the Service.
- Transfer: you may not transfer your account or these Terms. We may transfer them as part of a reorganisation, merger or sale, and your rights will not be reduced.
- Severability: if a court finds part of these Terms unenforceable, the rest still applies.
- No waiver: if we do not enforce a term immediately, we can still enforce it later.
- Notices: we may send notices to the email address on your account or show them in the app.
